Dish Network Sues ZemTV and TV Addons

Over the last few days Torrentfreak.com announced that Dish Network has filed a lawsuit against Zem TV and TVaddons.ag for copyright infringment, you can view the docmentation here. This accusses them of direct infringment of various tv channels in the addons. The legal suit states the following

COMPLAINT
Plaintiff DISH Network L.L.C. (“DISH”) brings this suit against Defendant Doe 1 d/b/a
ZemTV and Does 2-4 individually and together d/b/a/ www.tvaddons.ag, www.tvaddons.org, and
www.streamingboxes.com, and states as follows:
Nature of the Action
1. DISH brings this suit for copyright infringement to stop the ZemTV service’s
unlawful retransmissions of television channels exclusively licensed to DISH throughout The United States. The ZemTV service is retransmitting these channels over the Internet to end-users
that download the ZemTV add-on for the Kodi media player, which is available for download at
the websites www.tvaddons.ag and www.tvaddons.org. Defendants profit from this scheme by
encouraging ZemTV add-on users to make donations through Amazon or using PayPal at the site
www.streamingboxes.com. DISH has not authorized Defendants to retransmit these channels or
received any compensation from Defendants.

ZemTV like other add-ons that allow you to stream live tv channels from various places. TV Addons.ag is the repo source which provides us all the different add-ons. Keep in mind that Kodi itself is an open source media center application that allows people to use their own content. But due to the popularity of TVaddons.ag and making it easy for anyone to load Kodi with TONS of great sources for movies, tv shows, and more has made Kodi the “piracy king”.

Dish Network claims that they have sent numerous requests for cease and desist take down requests to TVaddons.ag in the past. According to the post from Torrentfreak.com,

“This is the first we’ve heard of this lawsuit. No one ever sent us any type of takedown or DMCA notice or even tried to contact us prior, they could have easily done so through our contact page or site emails,” TVAddons informs us.

TVAddons says that the ZemTV add-on was already removed prior to the lawsuit due to a technical issue, and it won’t return.

“The Zem addon was actually removed from our add-on library and community tools weeks ago due to a completely unrelated technical issue. I have already spoken to the developer, and he has since deleted the Zem addon entirely,” the TVAddons representative says.

Dish Network wants to hold ZemTV accountable for direct copyright infringement, demanding $150,000 per infringement in damages. Since this has came out a lot of third party developers have quit their add ons and some for good. One of our favorites One242415 pretty much said he is done for good. Here is a list of the add ons in Kodi that have stopped working since this announcement.

So what does this mean for all of us that use Kodi and these add-ons?

First of all, we have to see how this all plays out. As of now, it will affect tons of users especially people like ourselves that have a build. Builds are created to make it easier for everyone to use TVaddons.ag’s add-ons without having to maintain the sources etc. For everyone else, it means your favorite add-ons will no longer work. Add-ons in the past have come and gone and yes there will be more but depending on how far this lawsuit goes that can change.

What do we think will be the final outcome?

Tvaddons does NOT make these addons for profit. Their system is set up for donations. Tvaddons does not host the content themselves. That is not illegal. Not sure if Dish Network can try and see if they can get Tvaddons for any other infringements but we will have to wait and see.

As for the end users, you can

1. Wait for it to see how it all will play out and see if the add-ons will return.

RIP Exodus? Lambda is retiring! UPDATED

Update 2-3-17: Had to verify sources and through members. The original story was it was going to be gone and the team was going to be under a new name but under a new add on. CONFIRMED it will remain under Exodus!


Lambda the developer has announced that he will be retiring and that the Exodus add on will no longer be updated. The latest release 3.0.5 is the final update. There has been some news that there has been some malicious code in Exodus affecting StreamHubs server requests. There have been instances of other add ons stealing Lambda’s code and used as forks in the past. Schism has brought it to the attention of Lambda and this was just the beginning. Now Lambda said he will be retiring. This is from the TV Addons forums:

 

I am in the bridge of retiring or doing this.

Like I said they try to find my identity and give me legal trouble.

I have no choice to protect myself.

If this won’t help me to defend myself I will retire from these and focus on my legal add-ons.

And I wouldn’t if they didn’t try to expose my real identity and give me legal trouble.

The reason for not adding this on the changelog is that this would give them what they want, attention.

I am developing addons for.7 years, I have a very valid reason for doing this that have to do with MY REAL LIFE SAFETY.

And I am happy this happened, this way I can see clearly who is a friend or a foe for me on this scene 🙂

I am developing this addon for many years, it’s the continuation of Genesis.
All these years this community was a nice place to be a part of.

I didn’t wake up one day, after all these years and told myself, let’s try to add some calls to a specific site.
It was a bad desicion I made after all this time and the stessful months I had, and I am sorry about that.
As long you follow the GPL license and don’t remove Exodus credits from it I never had any problem.

Unfortunately all these months I’ve seen add-ons taking my code and removing the credits from it, like it’s their playground. I do understand that we are talking about addons that help on copyright infringement, but this is something I couldn’t tolerate anymore.
Also lately I’ve seen some weird private messages from specific people threating me on presonal level.
Most of them are on social media right now talking about how evil I am.

I just couldn’t deal with all this stress anymore, I made bad desicions that I shouldn’t take and I am sorry about that.
I think this is the time for me too leave, this whole thing is changing me as a person, so it’s time for me to take care of myself and leave this scene once and for all.

I want to thank everybody who stood by me all these years.
It’s time for me to move on and I hope the team to take over my beloved addon.

What will this mean for the addons? Lambda has been a huge contributor in the Kodi community. Paving the way with all of his recent work. We have to wait and see how this will all play out. New add ons come and go but its hard to find a good solid one such as Exodus. =(

Comcast ditching cable boxes for Roku boxes.

 

Comcast just announced it’s plan to start bringing subscribers an alternative to cable boxes. The cable box manufacturer Arris International PLC down as much as 9.3 percent to $26.05. They plan to sign up customers with a Roku instead of the X1 system to save $2.50 towards their monthly bill. With all the boxes on the market right now and Kodi/Plex spreading like wildfires, it is a smart move for all major companies to push their product this way. Amazon recently announced teaming up with tv manufacturers to have their OS pre-installed.  Could be one way to cut the cord, but we will have to wait and see what kind of plans roll out with the Roku.

1st Gen Nvidia Shield getting some love!

Recently Nvidia announced a new Nvidia Shield TV Console. In several comparisons, the specs hardware remains very similar but the controller received some cosmetic changes. It has more of a polygon look to it. It does do 4K HDR along with some of the features. Today Nvidia released an update for us 1st gen Nvidia Shield owners which allows doing the same 4K HDR as the new one.  So if you don’t have a Nvidia Shield already, then the new one would be worth buying. If you already have one, this new update will still make it a solid unit.

Mi Box Android 6.0 4K Unboxing

Xiaomi released their new Android TV box recently and we got our hands on one of the units. They want to be part of the set top box market and see if their new device is capable of being part of the cord cutting conversation. There are tons of devices out the such as the Amazon Fire TV, Apple TV, and of course the Nvidia Shield, a favorite amongst everyone in the community. Amazon Announces A New Fire TV Stick Scheduled Release Late October 2016

Amazon announced today their new Fire TV Stick set to debut late October 2016. The current versions of the Fire TV Stick have a dual core processor and if you want the voice option you have to get the most expensive one with the voice remote. The new Fire TV Stick will have a quad-core processor, Wi-Fi (802.11ac MIMO); and will now come bundled with an “Alexa” remote. It still will not support 4K but hopefully, the upgraded quad-core processor will show some improvement while watching your favorite tv shows or movies. This has been an issue in Kodi community with people loading big builds on the Amazon Fire TV Stick and it runs like shit! No mention of a new Amazon Fire TV Box, but they are offering a $65 media buying credit to customers who activate their new sticks before the end of October. Let the Ebay Listings begin!

Kodi going paid?

A few videos have circulated over the weekend regarding this topic. Kodi going paid! After watching the video, these guys pretty much started a big scare in the community. If you are not familiar with Solomon and Husham they released a few videos discussing this topic. Basically saying the add-on developers are getting tired of not receiving donations etc. They refer to the “paid service” as in using Real Debrid. Real Debrid is a great service. I’ve been using for a while now and it works very well. You pay for private links and it enables better quality content. That is an option. This is what they refer to as Kodi going “paid”! People need to stop spreading rumors about Kodi and until we hear it directly from the developer then it is true. Would a paid option be a bad thing? Let us know what you think. But for now, KODI IS NOT BECOMING A PAID SERVICE!.

Wake up call for the Kodi community. Beast gets shut down, but it RETURNS!

imgresRecently the Beast Kodi build has received a copyright notice and tweeted out he would be stepping down. If you are not familiar with the Beast build or you are living under a rock, it is one of the most known builds in the Kodi community. Since the notice, they have closed the domain http://www.thebeastkodi.com. So what does this all mean? It pretty much is a wake-up call for all the Kodi builds. The companies came after the Beast’s personnel and pretty much said he “take your shit down or else”.

We all have our personal taste when it comes to the way we want to set up our Kodi app. It is good to have options. Not everyone has the knowledge on how to make a build. The thing that is an issue here is that The Beast didn’t host any files, tv channels, etc. He just became a target and they want to make an example of him in the Kodi community. Every country has its own laws regarding copyright material. We’ve heard of box sellers getting busted in the UK for selling devices loaded with builds.

It’s a gray area in the Kodi world. Add-ons provide the content but the end user doesn’t host the files. Its is not illegal to stream but the way things are going, anything can change in an instant. But good news for you Beast supporters they are back. Do your research and look up the new URL. With all the recent events amongst sellers, Youtubers, we  just need to all know that we don’t own Kodi. We all should contribute and do what we can to enjoy it while it lasts. Trying to take down others is definitely not the answer.

Is YouTube hurting Kodi?

Here is a great read for all in regards to add-ons and Kodi. Kodi is and has always been a free Media Center app. Since the beginning of time, it allowed you to add your own legal media and stream to your TV, computer, etc.  Now Kodi is even bigger than ever and it can be utilized on any platform pretty much. While the third party add-ons are great, other things are hurting the community. If we were to break it down and do a poll on how people utilize Kodi, I am sure the results would show a majority of users are using unofficial third-party add-ons to stream tons of content. A lot of the media people have on their computers has in some way shape or form been downloaded illegally. After reading the article below from TVaddons.ag, they are specifically saying YouTubers are hurting the third party add-ons. One by drawing unwanted attention to the Kodi community and also certain add-ons. That being said, Kodi Fire TV is a site/blog to review everything Kodi related. We do have a YouTube channel ourselves. The material we review or do tutorials on is to show the hard work the developers have put in to give us an alternative to the main culprit and that is the cable companies. If prices and options were better for legal services I am sure we would all be up for it. Channels rely on Marketing Heaven for views and promotion. Sometimes cable plans are extremely overpriced and they include unwanted hidden fees for limited channel lineups etc or the availability of speeds in our cities.   We are passionate about Kodi and have been since XBMC on the original Xbox. To say that Youtube is hurting Kodi or add-ons is 50/50. Some people actually love it and just want to share their knowledge. While others are in it for a quick buck to sell set-top boxes with crappy builds etc. At the end of the day, we live in a very social media filled world now where no matter what happens all you have to do is Google something and it will be there. If it’s not YouTube it will be another video site or social media app. The sad reality is that Kodi is being utilized for good and bad. There are many other social media apps including Plex which now people are doing the same. There will always be something new coming up and there will always be illegal/legal media. Maybe it’s time we just all need to join forces in the Kodi community and figure out solutions so everyone is happy.
